In accordance with the law n ° 17-07 modifying and supplementing the code of criminal procedure, the Algerian legislator, corroborated his will to maintain the jury system by the reinforcement of the presence of popular elements in the making up of the criminal Court.

However Now a days, this orientation raises many questions because of the insufficiency of grounds pleading for the maintenance of a controversial system from the point of view of jurisprudence the decline in its implementation in several laws of the countries which have adopted it.

In view of the novelties experienced by the criminal court, which is, experiencing restrictions within its jurisdiction, which makes its judgments subject to appeal in addition to the obligation to motivate them.

The jury system is more than ever challenged as the presence of non-professional elements in the making up of criminal court is one of the reason, which hinder the implementation of the constitutional mainstay of a fair hearing.

Le législateur algérien a confirmé à travers la loi n° 17-07 modifiant et complétant le code de procédure pénale sa volonté de maintenir le système des jurés par le renforcement de la présence d’éléments populaires dans la composition du tribunal criminel.

Or actuellement, cette orientation soulève beaucoup de questionnements devant l’insuffisance de motifs plaidant le maintien d’un système sujet à débat en doctrine, et dont l’application est en net recul dans les législations de pays qui l’ont adopté.

Eu égard aux nouveaux développements que connait le tribunal criminel qui subit des restrictions dans la portée de ses spécificités, de par le fait que les jugements rendus par le tribunal criminel sont susceptibles d’appel en plus de l’obligation de les motiver, le système des jurés est plus que jamais remis en cause tant la présence des non professionnels dans la composition de tribunal criminel est l’une des raisons qui font obstacle à la mise en œuvre des principes constitutionnels du procès-équitable.
