If we take a close look at the disciplinary regime of the public service in Algeria, it must be noted that the disciplinary power exercises total domination over the disciplinary guarantees of the public official.

This is because it is the administration, which is both that which accuses and that which is responsible for the investigation and application of the sentence.

It also dominates the joint administrative commissions.

This legal finding in the disciplinary system of the public service is the result of the ineffectiveness of the legal standard in the organization of this area.

What makes administrative efficiency prevails over the guarantees of the civil servant.

This is why it is necessary for the Algerian legislator to review and re-examine disciplinary system of the public service in order to establish the fairness between the guarantees of civil servant and the administrative efficiency especially with regard to the disciplinary instruction and the autonomy of administrative disciplinary commissions.

الملخص FRE

À bien considérer de près le régime disciplinaire de la fonction publique en Algérie, force est de constater que le pouvoir disciplinaire exerce une totale domination sur les garanties disciplinaires du fonctionnaire public.

Etant donné que c'est l'administration qui est à la fois celle qui accuse et celle qui est chargée de l'instruction et de l'application de la peine.

Elle domine également les commissions administratives paritaires.

Ce constat juridique dans le régime disciplinaire de la fonction publique est le résultat de l'ineffectivité de la norme juridique dans l'organisation de ce domaine.

Ce qui fait que l'efficacité administrative l'emporte sur les garanties du fonctionnaire.

C'est pourquoi il est nécessaire pour le législateur Algérien de revoir et de réexaminer le régime disciplinaire de la fonction publique afin de consacrer l'équilibre entre les garanties du fonctionnaire et l'efficacité administrative, surtout en ce qui concerne l'instruction disciplinaire et l'autonomie des commissions administratives disciplinaires.
