The purpose of this paper is to investigate the state of play of application of the Algerian law relating to e-commerce and to make a diagnosis.
To achieve this, we attempted to analyze a sample of twelve (12) Algerian e-commerce websites.
We have highlighted the conformity of their form and conditions of sale with the provisions of the said law.
Our investigation has shown that the majority of e-commerce Algerian operators have not yet fully complied with the legislation.
We have also pointed out several shortcomings in the current legislation that may hinder the development of electronic commerce in Algeria.
الملخص FRE
L'objectif de cet article est d'enquêter sur l'état des lieux de l'application de la loi algérienne relative au e-commerce et de lui faire un diagnostic.
Pour y parvenir, nous avons tenté d'analyser un échantillon composé de douze (12) sites algériens de commerce électronique.
Nous avons mis en exergue la conformité de leur forme et conditions de vente aux dispositions de ladite loi.
Notre enquête a pu démontrer que la majorité des opérateurs de l'activité ne se sont toujours pas entièrement conformés à la législation.
Nous avons par ailleurs signalé plusieurs lacunes dans la législation actuelle qui risquent de freiner l'évolution du commerce électronique en Algérie.
