The Palestinian Legislative Council issued the High Criminal Court Act No.

9 of 1818، concerning the procedures for the prosecution of serious crimes.

The researcher discussed this subject and raised a very important question، which was to what extent the Palestinian legislator has succeeded to organize the procedures of due process litigation before the High Criminal Court in a way that guarantees the fair trial criteria، or did these texts fall short and do not meet the need of them.

In response to this question، the researcher adopted the analytical approach and concluded that the High Criminal Court is important to end the recession and delay the adjudication of major criminal proceedings، especially as it is consistent with the basic rules of fair trial.

The researcher recommended that a lawyer should be appointed to defend the accused in the crimes falling within the jurisdiction of the High Criminal Court in the preliminary investigation stage.
