الملخص الإنجليزي

This study deals with the issue of the humanitarian asylum right as a result of armed conflicts and its serious consequences.

As this phenomenon is considered as the oldest human phenomenon all over the world history.

In addition that asylum is a phenomenon accompanied persecution, wherever persecution exists; asylum shall be existed too.

Asylum reasons are so many like international and internal armed conflicts and human rights serious violations, climate disasters, lead to million refugees seekingfor safe place because they are afraid of persecution which they may face inside their countries or where they live.The importance of this study is related to the huge increase of the asylum phenomenon, and the armed conflicts especially the non international ones for example the huge wave of refugees insome of the arab countries during the Arab Spring.

Whereas the trouble of this study is to indicate the protection that theses asylum had regarding he armed conflicts and inability to give them necessary protection regarding to those large numbers.

The study reached some results such as any person has persecution in his original homeor his resident countries; shall has the right of human asylum and to get protection and international assistance according to1951 Refugees convention andthe additional protocol for 1967.

Whereof that study concluded to many recommendations,the most important recommendations, is to have a new international convention for refugees to follow up the internationally hurried quick developments; as to assure giving the help and assistance for most of the asylumseekers around the world.
