The French constitutional institution adopted the method of political control over the constitutionality of laws through the establishment of the constitutional council as independent political parties due to the lack of confidence in the judicial authority, and thus with the aim of protecting the basic rights and freedoms of individuals and ensuring respect for the principle of the constitution.

The problem of this study revolves around the effectiveness of the mechanisms on which the Constitutional Council depends on the exercise of its oversight role in order to consecrate its political character? In order to deal with the issue in various aspects, the descriptive approach to this study was adopted in addition to the analytical approach in dealing with the legal texts and we concluded that the lack of previous political control exercised by the Constitutional Council according to the notification mechanism was the reason for activating subsequent judicial review of the constitutionality of laws, by recognizing the right of individuals to litigate in front the Constitutional Council indirectly through the Priority issue of constitutionality.

Le consituant constitutionnel français a adopté la méthode du contrôle politique de la constitutionnalité des lois par la création d'un conseil constitutionnel en tant qu'organe politique indépendant en raison d'un manque de confiance dans le pouvoir judiciaire, afin de protéger les droits et libertés fondamentaux des personnes et de garantir le respect du principe de la suprématie de la constitution.

La poroblématique de cette étude est l'éfficacité des mécanismes sur lesquels le conseil constitutionnel dépend de l'exercice de son rôle de contrôle afin de consacrer son caractère politique? Afin de traiter la question sous divers aspects se sont fié sur l'approche descriptive appropriée à cette étude, en plus de l'approche analytique dans le traitement des textes juridiques, nous avons conclu que l'ence de contrôle politique antérieure exercé par le conseil constitutionnel conformément au mécanisme de saisine a été motivée pour activer le contrôle judicaire a posteriori de la constitutionnalité des lois, en reconnaissant le droit des individus dans un litige devant le conseil constitutionnel, de manière indirecte par la question prioritaire de constitutionnalité.
