The modern theoretical scientific approach that combines Sharia and law, in which we dealt with the definition of orphans legally and legally and the importance of caring for them and their conditions, they need care because they were deprived of the kindness of their parents and their tenderness the thing that is not compensated by the world and what is in it and we strengthened it with the presumed evidence from the book and the Sunnah of the Prophet, and between us that God Blessed and Almighty defended orphans and their property, and possesses charges in the Holy Qur’an with texts in which it defends them and their money and calls for it not to be wasted and disposed of except with what is better.

The research also includes the statutory legal aspect that talks about children and their rights in the Iraqi legal regulations and the constitutions adopted by the International Organization for Human Rights, especially orphans, in which it is evident that they have not neglected the rights of children in Iraq and in the world because they are the first of care and affection, and this is documented by the decisions and legal materials considered and approved We particularly mention in this regard the orphans of the children of ISIS, the terrorist organization that fought in Iraq, in Syria and elsewhere and left thousands of victims behind.

Their orphans belonging to them, like others, have no strength, as they became a victim of the mistakes of their fathers and mothers.

The research presented the legal protectionist approach to the orphan victim who has been tortured in prisons and detention centers.

When do consciences and live hearts move to remove injustice from these children and return them to their homelands and the homelands of their fathers and mothers? In this regard, the research proposes to rehabilitate them through centers specializing in childhood care and enjoying their right to education, medical treatment, adequate food and housing, and that the human conscience is required to find a fundamental solution for the relief of children, families and orphans, as the legitimate (sharia) and law are an inseparable title that serves both man and his rights in the world.
