ـ تجد حقوق الأقليات مصدرها الشرعي في النصوص القانونية التي تحويها لكن هذه النصوص الدولية قليلة جدا.
أهمها المادة 27 من "العهد الدولي للحقوق المدنية و السياسية" (1966) وهي النص الدولي الوحيد الملزم للدول الأطراف على مستوى عالمي رغم ما وجهت لمضمونها من ملاحظات.
كما أن "إعلان حقوق الأشخاص المنتمين إلى أقليات وطنية أو عرقية لغوية و دينية" (1992) يبقى النص الرسمي الوحيد المستقل الصادر عن الأمم المتحدة بخصوص الأقليات و هو بالتالي مهم رغم افتقاده لصفة الإلزامية.
أما إقليميا فإن "الاتفاقية الإطارية الأوربية لحماية الأقليات الوطنية" (1995) هي معاهدة خاصة بالأقليات "الوطنية" في أوربا فقط و حتى إن كانت ملزمة لكنها تحوي مبادئ عامة لا تنفذ مباشرة.

The rights of minorities find their legal source in the official texts.
Unfortunately, these international texts are too few.
The most important of these is the article 27 of the famous "International Covenant on Civil and Political Rights" (1966).
This article is the only universal obligatory text for member states despite the critics made about its content.
The 1992 "Declaration on the Rights of Persons Belonging to National or Ethnic, Linguistic or Religious Minorities" remains the only official autonomous text emanating from the United Nations specifically concerning minority rights.
This declaration is, as such, important but not binding.
As for the regional level, "the European framework convention for the protection of national minorities" of 1995 is a treaty relating to "national" minorities located exclusively in Europe.
It is certainly binding, but it only contains general principles that cannot be applied directly, except after adaptation to national particularities and official integration into the internal legal system
الملخص FRE
Les droits des minorités trouvent leur source légale dans les textes juridiques qui les contiennent.
Malheureusement, ceux - ci sont trop peu nombreux.
Le plus important d’entre eux est l’article 27 du fameux "Pacte International des Droits Civils et Politiques" (1966).
Cet article est le seul texte international – universel - contraignant pour les Etats membres malgré les remarques faites à propos de son contenu.
La "déclaration sur les droits des personnes appartenant à des minorités nationales ou ethniques, linguistiques ou religieuses" de 1992 reste le seul texte officiel autonome émanant de l’O.N.U concernant spécialement les droits des minorités.
Cette déclaration est, à ce titre, importante mais non contraignante.
Quant au niveau régional, "la convention-cadre européenne pour la protection des minorités nationales" de 1995 est un traité relatif aux minorités "nationales" se trouvant exclusivement en Europe.
Elle est contraignante certes, mais ne contenant que des principes généraux inapplicables directement, sauf après adaptation aux particularités nationales et intégration officielle au système juridique interne.
