Restricting marriage to a certain age and its effects on the prospective of Islamic jurisprudence

It is the jurisprudence of Islamic law that they paid great attention to the family, and focused on that relationship between the spouses as, they are the pillars of the family and its basis, So God Almighty ordained marriage and put basis for its form what maintain race.

He also put controls to establish the Muslim family and granted it rules and legislation that guarantee rights and benefit for it.

In recent legislation, the state has codified the setting of a specific age for marriage for girls what has caused great uproar over this issue, what led some Arab and Islamic countries to develop a law to determine a certain age for marriage of girls.

Hence, my research deals with this issue by showing its legitimate reality, and pros and cons result from it with showing the old and now jurists' opinions in this issue because jurisprudence argument is still sustainable on the extent of the legitimacy of determining minimum age for marriage and the extent to which the guardian is entitled to set controls and conditions in the public interest to achieve the purposes of the Shari'a in building the family accordingly.

This research was divided into an introduction, a preamble, three sections, and a conclusion.

As for the introduction.

I mentioned the importance of the subject, the reasons for its selection, the problem of research, its objectives and previous studies, the methodology in its writing, and the research plan.

I clarified in the preview what marriage is, the purpose of its legitimacy, and its legitimate rule.

I clarified in the first section the criteria of marriage eligibility.

In the second section I clarified the argument of jurists in determining a specific age for marriage.

In the third section I mentioned the implications of restricting marriage to a certain age, whether positive or negative and summarized in the conclusion the most important research findings and recommendations.
