الملخص AR
يعد التلوث السمعي من اخطر الملوثات البيئية الأمر الذي أدى إلى إصدار العديد من النصوص القانونية تحمي البيئة و الإنسان من أضرار التلوث السمعي و من أهمها المرسوم التنفيذي رقم 93-184 المنظم لإثارة الضجيج الذي يحدد المستوى الأقصى المقبول للضجيج في المناطق السكنية و الطرق و الأماكن العامة سواء في النهار أو في الليل.
فمن أجل توفير الراحة و الحفاظ على صحة الأفراد يستلزم على المشرع تجريم معظم الأفعال المسببة لتكدير هذه الراحة و معاقبة مرتكبيها و بذلك تستحدث جريمة جديدة يطلق عليها جريمة التلوث السمعي.
ترتكب جريمة التلوث السمعي بأساليب و أدوات حديثة و سلوكات مختلفة عن التصرفات التقليدية للجرائم الطبيعية جعل من أمر تطبيق الأركان التقليدية عليها من الأمور الصعبة بل أصبح لازما على المشرع تطبيق تلك الأركان بطريقة تساير الطبيعة الخاصة بجرائم التلوث السمعي التي تتميز بنموذجها القانوني الخاص الذي يميزها عن غيرها من الجرائم مما يضفي على أركانها خصوصية خاصة أيضا.

Noise pollution is one of the most dangerous environmental pollutants, which has led to the enactment of many legal texts that protect the environment and humans from the damage of noise pollution, the most important of which is Executive Decree n° 184-93 regulating the emission of noise which sets the maximum acceptable noise level in residential areas, roads and public places, day and night.
In order to preserve the health and comfort of individuals, however, the legislator is under an obligation to criminalize most acts that disturb this comfort by thus establishing a new offense called the noise pollution offense.
The noise pollution offense is committed with modern methods, tools and behavior different from the traditional behavior of the offense, which has made it difficult to apply the traditional elements.
Rather, it has become necessary for the legislator to apply these elements in a manner consistent with the nature of the noise pollution offenses, which are distinguished by their special legal model which distinguishes them from other offenses, which also give its elements a characteristic particular.
الملخص FRE
La pollution sonore est l'un des polluants environnementaux les plus dangereux, ce qui a conduit à la promulgation de nombreux textes juridiques qui protègent l'environnement et les humains contre les dommages de la pollution sonore, dont le plus important est le décret exécutif n ° 184-93 réglementant l’émission des bruits qui fixe le niveau de bruit maximal acceptable dans les zones résidentielles, les routes et les lieux publics, de jour comme de nuit.
Afin de préserver la santé et le confort des individus, toutefois le législateur est dans l’obligation de criminaliser la plupart des actes qui perturbent ce confort en mettant en place ainsi une nouvelle infraction appelé l’infraction de pollution sonore.
L’infraction de pollution sonore est commis avec des méthodes, des outils et des comportements modernes différents du comportement traditionnel des l’infraction, ce qui a rendu difficile l’application des éléments traditionnels.
Il est plutôt devenu nécessaire pour le législateur d'appliquer ces éléments dans un de manière compatible avec la nature des infractions de pollution sonore, qui se distinguent par leur modèle juridique spécial qui les distingue des autres infractions, qui confèrent également à ses éléments une caractéristique particulière.
