Freedom of the high seas and the absence of sovereignty on this area do not mean the freedom to pollute it or the absence of laws to protect and preserve its ecosystem.

This is because the issue of protecting and preserving the marine environment is considered as one of the most important restrictions on maritime navigation on the high seas.

This protection came to be embodied in the elaboration of international conventions, seeking to protect the marine environment from pollution on the high seas.

For instance, there is International Convention relating to Intervention on the High Seas in Cases of Oil Pollution Casualties 1969, as well as the United Nations Convention on the Law of the Sea 1982 that Algeria approved

La liberté d'exploiter la haute mer en l'absence de la souveraineté ne confère pas la liberté de la polluer et ne signifie guère l’inexistence de règles régissant la protection de l'environnement maritime car, la question de la protection et la sauvegarde de l'environnement maritime est, entre autres, les restrictions majeures répondant à la prétention de la libre navigation maritime dans la haute mer.

Cette protection est affirmée par la conclusion de conventions internationales concernant l'intervention tendant à protéger l'environnement maritime de la pollution dans la haute mer, dont celle de 1969 portant sur l'intervention dans la haute mer en cas de sinistre de nature ou susceptible d’engendrer la pollution par des marées noirs, ainsi que la convention des Nations Unies sur le droit de la mer de 1982 d’ailleurs approuvée par l'Algérie.
