الملخص FRE

à l’étude de la loi n° : 08/14 du 20 juillet 2008 modifiant et complétant la loi n° : 90/30 portant loi sur la propriété nationale algérienne, nous avons constaté que l’aspect le plus important de cet amendement est qu’il décrivait un nouveau type de contrat de concession qui n’était pas connu auparavant par le système juridique algérien, après avoir stipulé qu’il incluait soit l’utilisation d’un bien public, le financement ou l’utilisation d’un établissement public, on évoqué la possibilité de construire une entreprise qui à la fin de la période de concession, reviendra à l’autorité concédante.

Par conséquent, nous notons que la loi sur la propriété nationale amendée prévoit un nouveau type de contrats de concession appelé contrats de construction, exploitation et transfert de propriété, cette étude a conclu les avantages et les inconvénients des contrats de B.O.T.
