The minorities of Iraq, among minorities of other countries, have been subjected to violations throughout the ages, but these violations increased and worsened after the fall of the regime and the declaration of war on Iraq in 2003.

The minorities suffered a wave of violations and attacks.

These attacks extended to their historical places, religious constructions and cultural properties.

Since the status of the individual in international law has evolved and is not the same as before, individuals became members of public international law along with the State which was the only legal person of public international law.

The recognition of the individual as a person of public international law led individuals to be held accountable for the crimes committed violating the rules of international law under the jurisdiction of International Criminal Court.

The most prominent attacks against minorities in Iraq are classified as war crimes, crimes against humanity or genocide, whether suffered during the US occupation or during armed conflicts with terrorist organizations (ISIS).

Individuals accused with those crimes must be held accountable as violators of international criminal law, and be tried under the jurisdiction of the International Criminal Law.

Iraqi minorities, on the other hand, should be compensated for being subjected to grave violations in contrary to the international humanitarian law and international human rights law.
