Despite the evolution in work mechanisms, technology and means of transport, the pursuit to reduce all forms of occupational injuries and related incidents remain the primary challenges facing workers and employees at their place of work.

This has prompted international health and labor watchdogs and organizations to consider occupational injuries as an epidemic that must be eliminated or reduced.

Sustained efforts pushed for the formulation of legislation and laws offering protection and insurance against such risks.

This study seeks to highlight one of the most significant, and potentially the most serious, form of occupational injuries that is accidents on the way to work (commuting accidents).

The study examines the issues arising from having different and multiple legal texts governing this issue and the implications thereof on court decisions.

This study addresses this type of occupational injuries (commuting accidents), its concept, legal framework, and provides insight into its legal aspect before offering conclusions and recommendations.

The study concludes that there is a pressing need to enshrine commuting accidents and relevant provisions in laws rather than instructions and regulations that are subject to change and modification.
