This study aims to investigate the issue of the legal status of the air carrier's liability in the passenger transport contract in Iraqi law.

It became clear to us that the legislative position limits the scope of the general rule regarding compensation for the harmful act, as the Iraqi legislator has restricted moral compensation to the husband and relatives to the second degree and stipulated the death of the injured, but this does not agree with The rules of justice، This is because the apostate moral harm may be the result of a non-fatal injury, the reality of which is more severe than a fatal injury.

the study recommends the legislator the need to establish a law for air transport that clearly defines the responsibility of the air carrier, its dimensions and scope.
