الملخص AR
أمكن ظهور شبكة الانترنت للأفراد القيام بعملية النشر الالكتروني لمصنفاتهم الأدبية و الفنية على هذه الشبكة، و بسبب التطور التكنولوجي في البيئة الرقمية و ما تنتجه هذه البيئة من وسائل و أدوات تسهل من انتهاك المصنفات الرقمية بمختلف الصور، حيث كثرت الاعتداءات على المصنفات المنشورة في بيئة الانترنت، مما يشكل خطرا كبيرا على حقوق المؤلفين، و قد بات واضحا عدم جدوى الاكتفاء بالحماية القانونية التقليدية التي تقرها قوانين حماية الملكية الفكرية، فثبت عجز هذه النصوص عن توفير حماية كافية للمصنفات المنشورة في بيئة الانترنت في حالة الاعتداء عليها، فكان لا بد من إيجاد وسائل و تدابير تقنية تهدف الى حماية هذه المصنفات، فما كان من أصحاب حق المؤلف و الحقوق المجاورة الى ابتكار تدابير و وسائل تقنية لمواجهة اعمال النسخ غير المشروع من خلال بسط سيطرة المؤلف على مصنفه، عن طريق التحكم في نسخ المصنفات و الوصول إليها و منع الاستعمال غير المرخص به من قبل أصحاب الحقوق، و هذه التدابير التقنية التي توفر حماية تقنية للمصنفات أصبحت بدورها تقترن بحماية قانونية من خلال تجريم الأفعال التي تستخدم للتحايل على هذه التدابير على المستويين الدولي و الوطني.

The emergence of the Internet has made it possible for individuals to carry out the electronic publishing of their literary and artistic works on this network, and due to the technological development in the digital environment and the means and tools produced by this environment that facilitate the violation of digital works in various forms, as the attacks on the published works in the Internet environment abounded, which poses a danger It has become clear that it is not feasible to be satisfied with the traditional legal protection sanctioned by intellectual property protection laws.
It has been proven that these texts are unable to provide adequate protection for the works published in the Internet environment in the event of an attack on them, so it was necessary to find means and technical measures aimed at protecting these rights.
works, so what the owners of copyright and related rights were to devise measures and technical means to counteract illegal copying by extending the author’s control over his work, by controlling copying and accessing works and preventing unauthorized use by rights holders.

L'émergence d'Internet a permis aux particuliers de réaliser l'édition électronique de leurs œuvres littéraires et artistiques sur ce réseau, et en raison de l'évolution technologique de l'environnement numérique et des moyens et outils produits par cet environnement qui facilitent la violation d'œuvres numériques sous diverses formes, tant les attaques contre les œuvres publiées dans l'environnement Internet abondent, ce qui constitue un danger.
Il a été prouvé que ces textes sont incapables d'assurer une protection adéquate des œuvres publiées dans l'environnement Internet en cas d'atteinte à celles-ci, il a donc fallu trouver des moyens et des mesures techniques visant à protéger ces droits.
