Giving repressive power to independent administrative authorities reflects a primary objective, what has been called criminalization, as the sanctions imposed by these authorities reduce criminal criminalization, which reduces the role of the judiciary in this field, the creation of this phenomenon was in response to the objective of criminal policy and at the same time it is a tool at the service of economic regulation, because the transfer of criminal jurisdiction to these authorities raises the question of its specificity in relation to the criminal penalty, because it has the same purpose and is dissuasive, which is the substance of the administrative sanction in order to achieve its effectiveness in putting an end to such offences committed in order to protect the global public order, a specificity that is reflected in its sub-judicial administrative nature and in its protection of rights because of its gravity on what is the object of that sanction, In addition to the penalties for crimes committed if these authorities are not authorized to impose sanctions of deprivation of liberty, they impose severe penalties, ranging from financial penalties to professional sanctions.

Attribuer un pouvoir répressif aux autorités administratives indépendantes illustre un objectif principal, celui qu’on appelle la dépénalisation, car les sanctions imposées par ces autorités réduisent la criminalisation criminelle, ce qui réduit le rôle du pouvoir judiciaire dans ce domaine.

La création de ce phénomène a été une réponse à l’objectif de la politique criminelle et un outil au service du la régulation économique.

Mais le transfert de la compétence pénale à ces autorités soulève la question de sa spécificité par rapport à la peine pénale, car elles ont le même but qui est la dissuasion, et qui est le fond de la sanction administrative, afin d’atteindre son efficacité à mettre fin à de telles infractions commises et protéger l’ordre public global.

Cette spécificité apparait à travers sa nature administrative subjudiciaire et dans sa protection des droits, en raison de la gravité de l’objet de cette sanction, en plus des sanctions prévues pour les délits commis.

Si ces autorités ne sont pas autorisées à imposer des sanctions privatives de liberté, elles imposent des sanctions sévères, allant notamment des sanctions pécuniaires aux sanctions professionnelles.
