The study aimed to identify the legal framework for societal penalties in the penal legislation of the Sultanate of Oman and the Hashemite Kingdom of Jordan: a comparative study، And this is after the scientific، industrial، cultural and economic development and the increase in the population that led to an increase in crime rates as well as to the different types of crimes and the different means with which they are carried out، which led to an increase in the number of prisoners and the overcrowding of prisons.

This resulted in many negative effects and disadvantages of freedom-depriving penalties، as these effects and disadvantages have greatly affected some of the convicts from moral، psychological and economic aspects، as well as on society as a whole.

The study found that the criminal justice policy that is followed by most Arab and foreign legislation and focuses on its merits on the punishment policy، due to the high crime rate and the number of cases brought before the judiciary and their accumulation، which led to the trend towards adopting a system of societal penalties or the so-called alternative punishments as one of the alternatives to criminal justice.

Traditional in the modern era، as it is considered one of the modern methods of dealing with and facing criminal cases، which calls for the necessity of handling cases without resorting to formal trials، which contributes to the process of reforming and rehabilitating the individual.

And the integration into society with the aim of not renewing the crime، and imprisonment is one of the most severe punishments that persons who commit crimes are subjected to.
