The rapid development of telecommunications and information technologies' sector has significantly affected the pre-established principles of law and legal system.

Hence, the usual means of contract signing، including physical signatures, are no longer applicable for electronic contracts and electronic legal transactions.

Electronic signature is mainly used in authenticated legal documents and contracts that are filed electronically through different electronic communication means forming the E-signature operation system.

This has also led to the development of various forms of E-signatures, some of which are based on using mathematical formulas, letters, and optic and sound signals while others use biometric authentication technologies, which analyse the human’s physical and behavioral traits for identification purposes.

Technologies can only be reliable and authenticated depending on the level of accuracy and degree of certainty they provide, which also vary according to the ways these technologies are designed, produced, and implemented.

Such measures are taken into account when the legal concrescences of using the E-signature are studied.

The researcher has used comparative analytical methods in this paper, which has led to the following result: E-signature is the new form of contract agreements that has appeared due to the development of telecommunications.

It is recommended to establish an authentication body in Palestine which will document and supervise E-signed- documents and contracts.
