The paramount importance of the peaceful settlement of disputes in international relations is hardly debatable.
A universal order embodied by the United Nations system based on the prohibition of the use of force, must offer the States peaceful means of settling disputes, and this is the context in which the 1982 United Nations Convention on the Law of the Sea comes into play.
Due to its function as a framework treaty, according to its preamble, the objective of this convention is to settle all “problems concerning the law of the sea”.
And it is in the sense of wanting to settle disputes relating to the interpretation and application of its provisions that this convention provides a mechanism that is both complex and innovative.
الملخص FRE
L’importance capitale que revêt le règlement pacifique des différends dans le cadre des relations internationales n’est guère discutable.
Un ordre universel incarné par le système des Nations unies basé sur la prohibition de l’usage de la force, doit proposer aux Etats des moyens pacifiques de règlement des différends, et c’est dans ce contexte qu’intervient la convention des Nations unies sur le droit de la mer de 1982.
En raison de sa fonction de traité-cadre cette convention a pour objectif selon son préambule, de régler l’ensemble des «problèmes concernant le droit de la mer».
Et c’est dans le sens de vouloir régler les différends afférents à l’interprétation et l’application de ses dispositions que cette convention prévoit un mécanisme à la fois complexe et innovateur.
