الملخص العربي

أدت الاصلاحات الاقتصادية المنتهجة في الجزائر منذ مطلع الثمانينات إلى تحول عميق في دور ووظيفة الدولة في الاقتصاد، حيث انتقلت الدولة من متدخلة إلى ضابطة.

فالدولة لم تعد تتدخل في ضبط العلاقات الاجتماعية-الاقتصادية بالأساليب التقليدية كما كان في مرحلة سابقة لاسيما بواسطة القواعد القانونية التسلطية و ذات المصدر الدولاني، إنما أصبحت الدولة تشرك المعنيين بالقاعدة القانونية في إعدادها و إصدارها و السهر على تنفيذها.

وفي هذا السياق، تتجسد فكرة تراجع القانون التنظيمي التقليدي مقابل بروز فكرة الضبط الذاتي، ذلك أن مصدر إعداد القاعدة القانونية أصبح نابع من إرادة المخاطبين بها، مما يحقق فعليتها من حيث التطبيق في الواقع العملي.

فعوض أن تكون القاعدة القانونية صادرة عن السلطة العامة أصبح بإمكان أشخاص القانون الخاص في ظل الانفتاح الاقتصادي أن يمارسوا سلطاتهم في التفاوض حول سن القواعد القانونية الخاصة بهم

الملخص الفرنسي

The economic reforms carried out in Algeria since the 1980s have generated a profound change in the role of the State in the economy.

We are thus witnessing the passage from the interventionist State to the regulatory State.

Henceforth, the State no longer intervenes to regulate socio-economic relations by means of authoritarian regulations of State origin.

It is now a matter of associating the actors to determine their own standards of conduct and to ensure their application with the aim of effectiveness.

We are thus moving from classical regulatory law to self-regulation, where the place of elaboration of the legal rule comes from the actors concerned.

Indeed, the liberalization of economic activities and public services to private initiative has opened the field to private law persons to participate in the process of elaboration of norms.

Les réformes économiques opérées en Algérie à partir des années 1980 ont engendrées une profonde mutation du rôle de l'Etat dans l'économie.

On assiste ainsi au passage de l'Etat interventionniste à l'Etat régulateur.

Désormais, l'Etat n'intervient plus pour réguler les rapports socio-économiques au moyen de réglementations autoritaires d'origine étatique.

Il s'agit alors d'associer les acteurs pour déterminer eux-mêmes leurs propres normes de conduite et d'en assurer l'application dans un but d'effectivité.

On passe ainsi du droit réglementaire classique à une autorégulation où le lieu d'élaboration de la règle juridique est issu des acteurs concernés.

En effet, la libéralisation des activités économiques et de services publics à l'initiative privée a ouvert le champ aux personnes de droit privé pour participer au processus d'élaboration des normes.
