To address the questions raised by the paper, the paper follows the legal approach and the descriptive-analytical approach.

The paper reached several results, the most important of which are: Among the most important recommendations: Amending Article (28) of the Rome Statute, which established the responsibility of leaders and chiefs by including a text stating that the International Criminal Court is the competent authority to determine that the procedures were necessary and reasonable.
