The present Iraqi constitution of 2005 and the amended law No (21) of 2008 regarding the governorates that are not organized in a region, adopted the decentralization system for the management of these governorates.

However, the Iraqi legislature took a different course from the one followed by the other countries of the world that adopt the system of administrative decentralization, which gave rise to many legal problems.

This study aimed to shed light on the legal structure for oversight of decentralized administrative bodies and to clarify the main problem of ambiguity and contradiction in the legislation governing parliament’s control of decentralized administrative bodies.

It concluded with a set of results, the most important of which is that the foundations adopted by the Iraqi legislature to implement administrative decentralization system have been marred by many inconveniences and defects.

Some of the specializations specified by the legislator for the House of Representatives represent a departure from the original tasks of the Parliament.

This is added to the overlap of this jurisdiction with the jurisdiction of the judicial authority.

The research also reached some recommendations, the most important of which is the need for the Iraqi legislator to activate the administrative oversight of the central organs over the local organs, while establishing specific mechanisms for parliamentary supervision that are compatible with the basic oversight role of the parliament and are not in conflict with the competence of other oversight organs.
