في سياق مسعى الدولة الجزائرية لتسهيل و تنويع فرص الاستثمار، صدر المرسوم التنفيذي 21/145 مؤرخ في 17/04/2021 يحدد قائمة النشاطات التي تكتسي طابعا استراتيجيا، وذلك تطبيقا للمادة 50 المعدلة من القانون 20/07 مؤرخ في 04/06/2020 يتضمن قانون المالية التكميلي لسنة 2020، حيث تم تصنيف بعض أنواع نشاطات النقل البحري كقطاعات استراتيجية تتأكد الملكية الوطنية لها بنسبة 51% على الأقل أو ما يعرف بالقاعدة 51/49.

غير أن نصوص التشريع البحري المتعلقة بالاستثمار البحري بما في ذلك النقل البحري غير مواكبة لمستجدات المرسوم التنفيذي 21/145، مما يجعل العمل بالقاعدة 51/49 لا يراعي خصوصيات المعاملات البحرية و ذاتية القانون البحري، و من يوصي الباحث ببناء استراتيجية وطنية للاستثمار البحري تنطلق بإصدار قانون إطار للاستثمار البحري مع تمييز نشاط النقل البحري بما يختص به.

الملخص EN

As part of the efforts of the Algerian State in order to facilitate and diversify investment opportunities, Executive Decree 21/145 of 04/17/2021 was promulgated in application of amended article 50 of the Law 20/07 of 04/06/2020 on the complementary finance law for the year 2020, the executive decree enumerates the list of activities of a strategic nature, where certain types of maritime transport activities have been classified as strategic sectors for in which national ownership is at least 51%, or what is known as the 51/49 rule.

However, the texts of maritime legislation relating to maritime investments, including maritime transport, do not follow the evolution of Executive Decree 21/145, which means that the application of rule 51/49 does not take into account the particularities of maritime transactions, and the autonomy of maritime law.

As a result, the researcher recommends building a national maritime investment strategy which begins with the promulgation of a framework law for maritime investment, distinguishing maritime transport activity.

الملخص FRE

Dans le cadre des efforts fournis de l'État Algérien dans le but de faciliter et diversifier les opportunités de l'investissement, le décret exécutif 21/145 du 17/04/2021 a été promulgué en application de l'article 50 modifié de la loi 20/07 du 04/06/2020 portant la loi des finances complémentaire de l'année 2020, le décret exécutif énumère la liste des activités à caractère stratégique, où certains types d'activités de transport maritime ont été classés comme secteurs stratégiques pour lesquels la propriété nationale est stipulée à au moins 51%, ou ce que l'on appelle la règle 51/49 .

Cependant, les textes de la législation maritime relatifs aux investissements maritimes, y compris le transport maritime, ne suivent pas l'évolution du décret exécutif 21/145, qui fait que le l'application de la règle 51/49 ne prend pas en considération les particularités des transactions maritimes, et l'autonomie du droit maritime.

De ce fait, le chercheur recommande de construire une stratégie nationale d'investissement maritime qui commence par la promulgation d'une loi-cadre pour l'investissement maritime, en distinguant l'activité de transport maritime.
