After 2003' the Iraq has become surprisingly face to face with new , different economical system , and new realities in the field of production , consumption, investment , commerce and the international financial relations, accompanied by the diminished role of state owned sector in the field of production, dwindling the tax revenues and the unplanned state expenditure , contrarily the emergence of private sector role in international commerce and investment .

These facts necessitate complete revision for the structure of the Iraqi legislations to make them cope with these facts and cure these challenges depending on the mechanism of the changeable and the unchangeable as the best way to achieve positive responses.

For all that the research will depend on deduction and inference approaches in order to build innovative legal remedies which support the Iraqi legislative organs to develop the Iraqi legal system especially in the matters of international private law.
