نظرا لعدم وجود نص قانوني يتضمن التزام شركة التأمين بالنصيحة تجاه المؤمن له في الأمر رقم 95-07 المتعلق بالتأمينات، و نظرا لعدم وجود اجتهاد قضائي صادر عن المحكمة العليا الجزائرية لفرض هذا الالتزام، قمنا بهذا البحث لهدف ايجاد كيفية تكريس هذا الالتزام وكيفية تأسيسه القانوني في القانون الجزائري، عبر تحديد الأساس القانوني و نطاق هذا الالتزام تجاه شركة التأمين، مع تحديد المسؤولية المترتبة عن الاخلال بهذا الالتزام تجاه شركة التأمين من حيث الأساس القانوني لهذه المسؤولية و الجزاء المترتب عنها، حماية للمؤمن له تجاه شركات التأمين في الجزائر، عن طريق دراسة تحليلية للنصوص القانونية الجزائرية و مقارنتها مع القانون الفرنسي باعتباره الاكثر تطورا في مجال هذا الالتزام، لاستبيان نقائص القانون الجزائري في هذا المجال و ما يجب الأخذ به في القانون و القضاء الجزائري من محاسن و مستجدات القانون و القضاء و الفقه الفرنسي.

الملخص EN

Given the lack of legal text setting out the obligation of the insurance company to advise the insured in Ordinance No 95-07 relating to insurance, and given the lack of case law emanating from the Supreme Court Algerian imposing this obligation, we carried out this research work in order to find a way to concretize and legally establish this obligation in Algerian law through the definition of the legal basis and the scope of this obligation with determining the liability arising from the breach of this obligation towards the insurance company with regard to the legal basis of this liability and the sanction it entails in order to protect the insured against insurance companies in Algeria.

And this through an analytical study of Algerian legal texts compared to French law which is the most advanced in the field of this obligation by highlighting the shortcomings of Algerian law in this field and what must be taken into account in the law and jurisprudence Algerian by drawing inspiration from the advantages and the evolution of French law and jurisprudence.

الملخص FRE

Vu l’inexistence de texte juridique énonçant l’obligation de conseil de la société d’assurance envers l’assuré dans l’ordonnance n° 95-07 relative aux assurances, et vu l’inexistence d’une jurisprudence émanant de la cour suprême algérienne imposant cette obligation, on a procédé à ce travail de recherche afin de trouver un moyen pour concrétiser et assoir juridiquement cette obligation dans le droit algérien à travers la définition de la base juridique et l’étendue de cette obligation, tout en déterminant la responsabilité découlant de sa violation vis-à-vis de la compagnie d’assurance au regard de la base juridique de cette responsabilité et de la sanction qu’elle entraîne, et ce afin de protéger l’assuré contre les sociétés d’assurance en Algérie.

Et cela à travers une étude analytique des textes juridiques algériens comparativement au droit français qui est le plus avancé dans le domaine de cette obligation en ressortant les carences du droit algérien dans ce domaine et ce qui doit être pris en compte dans la loi et la jurisprudence algérienne en s’inspirant des avantages et de l’évolution de la loi et de la jurisprudence françaises.
