الملخص AR

تهدف هذه الورقة إلى دراسة مضمون الحماية الدولية للبيئة في ظل ثنائية متعارضة ألا وهي سيادة الدولة من جهة و كذا إشكالية التدخل الدولي من جهة أخرى باعتبار أن حماية البيئة أضحت محط اهتمام دولي واسع قصد ضمان حقوق الإنسان المنصبة على البيئة، لكن في خضم ذلك أصطدم مسعى حماية البيئة و كذا الحقوق المنصبة عليها بما في ذلك ضمان حقوق الأجيال المستقبلية بمشكلة سيادة الدول التي ترفض بشدة أي تدخل في شؤونها خاصة ما تعلق باستغلال الموارد البيئية.

الملخص EN

This paper aims to study the content of the international of the in light of a conflicting dualism, namely the sovereignty of the state on the one hand, as well as the problem of international intervention on the other hand, given that environmental protection has become the focus of wide international attention in order to guarantee human rights that are applied to the environment.

The environment, as well as the rights attached to it, includes guaranteeing the rights of future generations with the problem of sovereignty of states that strongly reject any interference in their affairs, especially those related to the exploitation of environmental resources.

الملخص FRE

Cet article vise à étudier le contenu de la protection international de l’environnement à la lumière d'un dualisme conflictuel, à savoir la souveraineté de l'État d'une part et la problématique de l'intervention internationale d'autre part, étant donné que la protection de l'environnement est devenue la focalisation d'une large attention internationale afin de garantir la protection des droits de l'Homme appliqués à l'environnement.

L’environnement, ainsi que les droits qui y sont attachés, y compris la garantie des droits des générations futures tombe en conflit avec le problème de la souveraineté des États qui rejettent fermement toute ingérence dans leurs affaires, notamment celles liées à l'exploitation des ressources environnementales.
