الملخص الإنجليزي

It is a duty of knowledge seekers students and researchers to extract the treasures of the Islamic heritage that scholars of previous centuries left for us on Islam, and this thesis deals with part of a book that is still manuscript, which is the book (An Nihayatul Othma the explanation of Al Ghayatul Quswa) by the scholar Muhammad bin Muhammad bin Zanki alIsfraini (died 747 AH), From the beginning of the chapter of felonies to the beginning of the fourth chapter of the Jizya contract.

This thesis consisted of an introduction and two study sections, while the introduction contained the issue of the study and its objectives, then the first section includes chapters of the study, an introduction of Imam alBaidawi and the Imam al-Isfraiyani and the approach of each of them in his book, and a description of the manuscript versions that I adopted in the study.

Then the second section is a study of the previous mentioned section of the book Al Ghayatul Quswa, from the beginning of the book of felonies to the beginning of the fourth chapter of the Jizya contract.

This book is one of the basics of Shafi’i jurisprudence.

As it is connected to a jurisprudential authority as it explains Al Ghayatul Quswa for Imam Al-Baidawi, which is a summary of one of the books of the Shafi'i scholars among the old scholars, the book is Al Waseet fi Al Mathhab for Imam Abu Hamid Al-Ghazali, and the scholar Al-Afrayans had fully explained this book, showing the difference in sayings and forms in the Shafi’i school, and the legal evidence for the various issues, and mentioning their explanations.
