إن الطابع العالمي للبيئة و مشكلاتها، دفع جانبا من الفقه إلى القول بوجود طابع دولي لقانون حماية البيئة و لجينية الحق في البيئة، اعتقادا منه بأن أكثريه المصادر التشريعية لهذا القانون و الاساس القانوني لهذا الحق هي اتفاقيات دولية الأصل، وأن المصادر الموضوعية لهذا القانون هي قرارات صدرت عن المؤتمرات و المنظمات الدولية، فضلا عن بعض المبادئ الدولية التي ترسخ لهذا الحق، و أن أغلبية أنشطة الاعتداء على البيئة تتجاوز بطبيعتها حدود الدول، و أخطر هذه الأنشطة هي أنشطة الدول نفسها، و أن قواعد قانون البيئة تحصي بالدرجة الأولى مصلحة مشتركة تتعلق بالتراث المشترك للإنسانية، حيث تمتد آثار الملوثات المدمرة إلى العديد من الدول، و عليه فأية جهود رامية لحماية الحق في البيئة على المستوى الوطني بمعزل عن الجهود الدولية تبقى محدودة الفاعلية، خاصة اذا اعتبرنا أن محل هذا الحق ( البيئة) يمثل تراثا انسانيا مشتركا للجيل الحالي و الجيل المقبل على حد السواء

The global nature of the environment and its problems have led part of the case law to say that there is a character of an international law for the protection of the environment and the genetic right to the environment, in the conviction that the majority of the legislative sources of this law and the legal basis of this right are international conventions of origin, and that the sources substantive of this law are decisions issued by international conferences and organizations, as well as certain international principles which enshrine this right and that the majority of the activities of aggression on the environment by nature exceed the borders of the States, and that the activities the activities of the countries themselves are more dangerous, and that the rules of environmental law reach mainly a common interest linked to the common heritage of humanity, since the effects of harmful pollutants extend to many countries, and Therefore Its efforts to protect the right to the environment at the national level Apart from international efforts, the efficiency is limited, especially considering that the place of this right (the environment) represents a common human heritage for the current generation and the next generation.

La nature globale de l'environnement et ses problèmes ont poussé une partie de la jurisprudence à dire qu'il y a un caractèreune loi internationale pour la protection de l'environnement et le droit génétique à l'environnement, dans la conviction que la majorité des sources législatives de cette loi et la base juridique de ce droit sont des conventions internationales d'origine, et que les sources substantielles de cette loi sont des décisions émises par des conférences et organisations internationales, ainsi que certains principes internationaux qui consacrent ce droit Et que la majorité des activités d'agression sur l'environnement par nature dépassent les frontières des États, et que les activités les plus dangereuses sont les activités des pays eux-mêmes, et que les règles du droit de l'environnement atteignent principalement un intérêt commun lié au patrimoine commun de l'humanité, car les effets des polluants nuisibles s'étendent à de nombreux pays, et donc Ses efforts visant à protéger le droit à l'environnement au niveau nationalEn dehors des efforts internationaux, l'efficacité est limitée, surtout si l'on considère que la place de ce droit (l'environnement) représente un patrimoine humain commun pour la génération actuelle et la génération suivante.
