لقد قامت جل الدول بدسترة الحق في البيئة، لإدراكها أن هذا الحق الأساسي تشترك فيه الإنسانية جمعاء، فالمقال يدرس الطرق التي انتهجتها الدول في دساتيرها لمعالجة الحق في البيئة، و ذلك بالارتقاء بهذا الحق لأعلى قواعد معيارية في الدولة و هو الدستور، كما يعالج موقف الفقه و القضاء من مسألة دسترة الحق في البيئة.
و لتوضيح مكانة هذا الحق في الدساتير المختلفة، أخذنا عينات مختلفة من الدساتير لعدة دول في العالم، و لأنظمة قانونية مختلفة، و حاولنا تحليل الآثار الدستورية المترتبة عن دسترة الحق في البيئة، حيث توصلنا إلى أن هناك معوقات لتجسيد هذا الحق تعود لاعتبارات عديدة، دستورية، اقتصادية و سياسية أثرت على مكانة هذا الحق الحديث في الدساتير المقارنة، بتحويله إلى حق شخصي ذاتي.

The majority of the countries opted for the constitutionalization of the right to the environment, to realize that this fundamental right is shared by humanity, this article discusses the position of doctrine and case law concerning the constitutionalization of the right to the environment.
and to clarify the place of right to the environment in different constitutions, we took different samples of constitutions for several countries in the world and for different legal systems, and we tried to analyze the constitutional implications of the process of constitutionalization of the law to the environment.
and we concluded that there are obstacles to the materialization of the right to the environment due to several considerations, notably constitutional, economic and political which have affected the position of this modern right in comparative constitutions, on the transformation of the right to environmental in subjective law.
الملخص FRE
La plupart des pays ont constitutionnalisé le droit à l'environnement, car ils se sont rendu compte que ce droit fondamentale est partagé par toute l'humanité.
L'article examine les méthodes que les pays ont adoptées dans leurs constitutions pour aborder le droit à l'environnement, et qu'en élevant le droit à l'environnement aux normes normatives les plus élevées de l'État, qui est la constitution, cet article traite donc de la position de la doctrine et de la jurisprudence sur la question de la constitutionnalisation du droit à l'environnement.
Et pour clarifier la place du droit à l'environnement dans différentes constitutions, nous avons prélevé différent échantillons de constitutions de plusieurs pays dans le monde et pour différent systèmes juridiques, et nous avons essayé d'analyser les effets constitutionnelles qui découlentde la constitutionnalisation du droit à l'environnement, et nous avons conclu qu'il existe des obstacles à la realization du droit à l'environnement en raison de plusieurs considérations d'ordre constitutionnel, économique et politique qui ont affecté sur la position de ce droit moderne dans les constitutions comparatives en convertissant le droit à l'environnement en un droit subjectif.
