Letters of undertaking (LOU) are documents usually issued by protection and indemnity (P & I) clubs in the field of insurance on international maritime trade activities, in order to prevent the imposition or to remove the attachment on the ships of their members as the suppliers and the carriers.

they are sums of money paid by the clubs to cover the damages caused by the supplier or carrier and which are determined by an agreement or a final court judgment with the intention of enabling the ship to leave the port of the harmful workplace.

despite the effectiveness of letters of undertaking (LOU) in resolving disputes due to their free nature and speed of issuance, unlike traditional bank guarantees, they raise many problems, especially at the stage of implementing their contents, which inflicts significant losses on dealers in the maritime trade sector, including Algeria, and accordingly causes great damage to the national economy.

this study aims to investigate the legal and practical truth of these letters, and their impact on the interests of the Algerian economy, by analyzing their system and ways of dealing with them.

it also suggests practical solutions to reduce their negative effects.

الملخص FRE

Les garanties P & i sont des documents émis par les clubs de protections et d'indemnités dans le domaine des assurances du commerce maritime international, pour empêcher la saisie conservatoire d'un Navire appartenant à un membre du club ou obtenir la mainlevée.

L’objectif de cette garantie est de s'acquitter des dommages et intérêts auxquels pourrait être condamné le transporteur ou l'armateur à payer suite à un accord ou à une décision définitive de justice.

Mais, malgré leur efficacité dans le règlement des litiges, du fait de leur gratuité et leur rapide émissions, contrairement aux garanties bancaires traditionnelles, les lettres de garanties sont à l'origine de nombreux problèmes liés à leur mise en oeuvre, causant aussi des dommages financiers aux opérateurs algériens et à l'économie nationale.

Cette étude tend à lever le voile sur la réalité de ces garanties et propose des solutions pour remédier aux effets néfastes qui résultent de leur mise en oeuvre en Algérie.
