الملخص العربي

يعد التظلم الإداري من الوسائل القانونية التي منحها المشرع للموظفين او الأفراد لمواجهة القرارات الإدارية المخالفة للقانون والتي تسبب اضراراً تمس مصالحهم فهو طريق لدفع الضرر دون الحاجة الى اللجوء الى القضاء الإداري والمطالبة بإلغاء القرارات الإدارية عن طريق دعوى الإلغاء وقد تطرقت هذه الرسالة الي موضوع التظلم الإداري وجاءت بعنوان التظلم وأثره على ميعاد الطعن بالإلغاء وقد جاءت هذه الرسالة بفصلين تناولت في الفصل الأول ماهية التظلم الإداري وأهمية التظلم سواء بالنسبة للموظف او الإدارة أو مرفق القضاء وتناولت ايضاً أنواع التظلم الإداري من حيث الجهة المقدم إليها ومن حيث الإلتزام القانوني بتقديمه وفي نهاية الفصل الأول ذكرت الدراسة اهم الشروط الشكلية والموضوعية الواجب توافرها حتى يعد التظلم مقبولاً من الناحية القانونية أما في الفصل الثاني فقد تناولت الدراسة بيان ماهية دعوى الإلغاء وأهم خصائصها وشروطها وتناولت أثار التظلم الإداري سواء على الفرد أو الإدارة او القرار المتظلم منه وفي الختام تناولت الدراسة موقف المشرع الأردني من نوعي التظلم الإداري الإختياري من جهة والإجباري من جهة اخرى.

وقد خلصت الدراسة الى ان الغاية الأساسية من التظلم الإداري هو تقليل الدعاوى المرفوعة أمام القضاء الإداري والتي ترهق كاهله بأعداها وايضاً خلصت الى أن المشرع الاردني نظم او أشار الى التظلم الاداري الوجوبي في المادة 8 من قانون القضاء الإداري رقم 27 لسنة 2014 في حين لم يشير اليه في قانون محكمة العدل العليا رقم 12 لسنة 1992 وخلصت ايضا الى ان نظام الخدمة المدنية رقم 9 لسنة 2020 قد نظم أحكام التظلم الإختياري.

Administrative grievance is one of the legal means that the legislator has granted to employees or individuals to confront administrative decisions that violate the law and that cause harm to their interests.

It is a way to pay the damage without the need to resort to the administrative judiciary and demand the cancellation of administrative decisions through the cancellation lawsuit.

The study dealt with the subject of administrative grievance and it came under the title of grievance and its effect on the date for challenging the cancellation.

The study came in tow chapters where the study dealt in the first chapter with the meaning of the administrative grievance and the importance of grievance Whether for the employee or the administration or the judiciary also dealt with the types of administrative grievance in terms of the party submitted to it and in terms of the legal obligation to submit it.

At the end of the first chapter, the study mentioned the most important formal and substantive conditions that must be met in order for the grievance to be accepted legally.

In the second chapter the study dealt with the meaning of cancellation lawsuit and Its characteristics and its terms and the study dealt with the effects of the administrative grievance, whether on the individual or the administration or the judiciary and in the end The study dealt with the position of the Jordanian legislator regarding the two types of voluntary administrative grievances on the one hand and compulsory on the other hand.

The study concluded that the main purpose of the administrative grievance is to reduce the lawsuits filed before the administrative judiciary, which exhausts its shoulders by their numbers , and also concluded that the Jordanian legislator referred to administrative grievance compulsory in the Jordanian administrative judiciary law No.27 for the year 2014 while he was not mentioned it in the supreme court of justice law No.12 for the year 1992 also The study concluded that the Jordanian Civil Service System No.9 for the year 2020 has organized the provisions of voluntary grievance.
