The purpose of our research is to determine the legal basis for the jurisdiction of the Iraqi administrative judiciary, and the need for a standard to determine the scope of this jurisdiction in the light of the method taken by the Iraqi legislator to determine because the legislation is the main source in the organization of the jurisdiction of the Iraqi administrative judiciary.

If the French Council of State was the nucleus of the French administrative judiciary, and laid down its most important principles and basic theories, including the principles of determining its jurisdiction so that the legislation has only a secondary role in this field, the opposite is true for the rest of the countries that adopted the dual justice system such as Egypt and Iraq, Since the birth of the administrative judiciary by the legislator, who undertook to develop theories and basic principles of the work of the administrative judiciary and the organization of its jurisdiction, while the role of the administrative judiciary in this regard, which emerged primarily in the development of a standard to determine And therefore our research on the basis of the jurisdiction of the Iraqi administrative judiciary requires the identification of the laws that established the Iraqi administrative judiciary and organized its jurisdiction, both for the federal administrative judiciary or the administrative judiciary of the Kurdistan Region - Iraq; to know the method adopted by the Iraqi legislator in determining the jurisdiction of the administrative judiciary, To determine the need to seek a legal standard to determine his jurisdiction.
