Technological development in the 20th century led to the emergence of new brands.

These brands do not rely solely on the sense of sight to be distinguished from others, but they have been developed to include other senses, such as hearing, smell and touch.

These types of brands are called (non-traditional trademarks), which include, for example, sound, smell, color, and three-dimensional marks.

This emergence led to controversy over several decades regarding the registability of color marks and whether they enjoy the legal protection provided by legislation and international conventions on trademarks.

In light of the absence of explicit provision in the UAE Trademark Law, that allows the registration of color as a trademark, the subject of this study was chosen to spotlight on the color mark in the UAE in terms of the extent to which it can be registered and protected by legislation in the UAE.

The study concluded that there is nothing to prevent the registration of color marks in the UAE and thus they enjoy the protection provided by the Trademark Law.
