The search for evidence is an essential pillar in criminal matters.

The legislator delegated to the criminal judge a broad authority over the choice of an irrefutable proof based on his inner conviction.

However, it is limited and not absolute when the existing evidence is conclusive.

However, when the evidence is lacking or is not conclusive and there is still a doubt in the mind of the judge, the assessment process must produce the same result as the maxim “in dubio pro réo”, namely the acquittal or the discharge that benefits the accused.

As such, the minutes (police report) with probative value can neutralize the presumption of innocence, the rule of favorable doubt, even, the inner conviction of the judge

الملخص FRE

La recherche de la preuve est un pilier incontournable en matière pénale.

Le législateur a délégué au juge pénal une large autorité quant au choix de la preuve irréfragable en se basant sur son intime conviction.

Cette dernière est, cependant, limitée et non absolue lorsque les preuves existantes sont probantes.

Or, lorsque les preuves font défaut ou qu’elles ne sont pas probantes et qu’il subsiste un doute dans l’esprit du juge, donc le procédé d’appréciation doit produire le même résultat que la maxime « in dubio pro réo » à savoir l’acquittement ou la relaxe qui profite à l’accusé.

A ce titre les procès-verbaux à force probante particulière peuvent neutraliser la présomption d’innocence, la règle du doute favorable, et même l’intime conviction du juge
