الملخص الإنجليزي

This study dealt with amatter of importance in practice where it dealt with legal regulation to prevent the debtor from travelling in Jordanian law and some comparative legal systems, As ameans of forced implementation.

The Jordanian legislator regulated the situation of the debtor's conduct with all it's money as smuggling outside the country or that he is about to leave the country.

The right to the creditor is granted through recourse to the court or to the judge of expedited matters afters the evidnces have been submitted to obtain adecision to prevent travel of the debtor , this shall be after the debtor has failed to provide or indicate the reason for his failure to provide afinancial or legal guarantor to ensure that he may be sentenced.

In order to cover the subject of the study , she divided it in to two main chapter was devoted to talk about the legal concept of preventing the debtor from travelling , where it touched up on the definition of what is preventing the debtor from travelling , it's legal nature , it's characteristics and it's legal and legislative basis , as well as clarifying the procedures for issuing the travel ban .

The second chapter was to talk about the legal effects of the decision to prevent the debtor from travelling , and it dealt with ways to challenge the decision to prevent the debtor from travelling and to indicate the effect of the disappearance of the status of creditor or debtor or losing of eligibility to the decision to prevent travelling and to determine the effect of the decision to deport from the country or to detain the debtor or his illness to prerent the debtor from traveling .

The study concluded with anumber of conclusions and recommendations.

The study recommends that the Jordanian legislator should benefit from the legislative experience of Kuwait and the UAE organizing the decision of preventing the debtor from travelling to face the problems raised by this subject .
