Summary of the research: The new Saudi bankruptcy system was issued including details of the seven bankruptcy procedures, which are preventive settlement of bankruptcy, financial reorganization, liquidation, preventive settlement of small debtors, financial reorganization of small debtors, liquidation procedure for small debtors, and administrative liquidation.

One of the objectives of this system is to achieve a balance between the interests of the defaulting or bankrupt with creditors, under the supervision of the commercial court that has jurisdiction over the consideration and implementation of the bankruptcy system procedures and its implementing regulations.

It also aims to create an investment climate that is more attractive to investors and more reassuring, stable and clear in commercial dealings, As this legal environment attractive to investors enhances the Kingdom's economic position.

It adds an integral element to the system of economic reforms to achieve the vision of the Kingdom of Saudi Arabia (2030).

This study deals with the nature of bankruptcy concerned in the provisions of this system, as well as the procedural aspect of submitting a preventive settlement request from bankruptcy, starting from the cases of submitting the application to the court until the end of the preventive settlement procedure and the penalties arising therefrom.
