الملخص AR

This research aims at grounding the rule: “choose the better of two good deeds by yielding the less worthy and chase away the worse of two evils by bearing the less wicked” by defining its theoretical aspects, origins and perceptions, and then applying it to the issues of sustainable development.

Sustainable development is a new pattern of growth that has gone beyond the goal of increased productivity and consumerism.

It seeks to bring balance between production, social rights, the protection of environmental resources, and the sustainability of its benefits.

It is based on three fundamental elements: (1) economic: by considering the quality of production and the balance of its quantities; (2) social: by ensuring the justice of distribution and conservation of consumption,; and (3) environmental: by being friendly with it.

Within this framework, this instrumental rule will be evaluated in a plethora of sustainable development issues in relation to their economic, social, and environmental aspects, in addition to specifying the effect of choosing between opposed benefits or abuses.

The results of this research include: (1) this rule has a strong relationship with the jurisprudence of budgets; it is part of the basic infrastructure and its diagnostic tools; (2) sustainable development is, in its judicial aspect, a developmental process in which man beneficially interacts with his milieu to sustain what is available in the present and the future; and (3) this rule has an effective and authenticated role in weighing the issues of sustained development and its conservation: the evidence of this is the availability of applications that are exceptions to the rule.
