الملخص الإنجليزي

The strike is considered one of the constitutional and fundamental rights dealt with by most Western and regional legislations.

It called for and recognized many international and regional conventions, but this right was not absolute, but was restricted according to national laws and legislations.

Jordan was among the countries that banned the public servant in the public sector, based on the principle of the regular and steady functioning of the public utility and organized for workers in the private sector under certain controls.

The present study aims to clarify the concept of the right to strike and its characteristics and historical development and distinguish it from similar concepts, the forms of exercise of this right and the most important restrictions restricting this right, and the effects resulting from the tangibility of this right This study also showed the texts of international and regional charters dealing with the right to strike and called for it and the compatibility of national legislation and laws in France, Egypt and Jordan with these charters.

The study recommended the need to pay attention to collective bargaining and give it the status of binding, as the language of negotiation and dialogue may lead to good results before resorting to strike, and the need to amend some provisions of the law that contradict the provisions of the Jordanian Constitution.
