Economically, the contractual balance is considered one of the most important criteria for achieving justice in this contract, but the great economic development has caused an imbalance in the position of the contractual relationship and made them unequal and inequivalent as a result of the dominance, professionalism or the economic influence of one of the parties that is always in his interest, subsequently, it leads to the disruption of balance between the rights and commitments of the contractors by imposing the conditions of one of the parties upon the other party, whereas the first has a certain economic influence and as in state of weakness, a lack of equality between the two parties results from the second party, and therefore, the judge has to provide protection for the weak party and to modify the listed conditions in the contract if it turns out to be arbitrary in order to restore the balance between the contractors.
