The Algerian trade law regulates bankruptcy provisions in articles 215 to 388, but it does not comprise regulations specific to the bankruptcy of businesses, even though it does make some incidental references to that of partnerships.

Normally, the same regulations that apply to individual traders should also apply to the bankruptcy of the different types of companies, but that may present some difficulties considering that companies are legal persons.

This entails looking for the peculiarities of business bankruptcy and determining the criteria specific to it.

The main aim of this study is to describe and analyze the formal and objective conditions of the bankruptcy of businesses as well as to illustrate the regulation peculiarities of their declaring it.
