الملخص العربي

عالجت الدراسة مسألة تسليم المبعوثين الدبلوماسيين المتهمين بارتكاب جرائم الحرب، في ظل تمتعهم بالحصانة القضائية التي تعفي في شقها الجزائي المبعوثين الدبلوماسيين (الدائمين والمؤقتين) من الخضوع للقضاء الجنائي للدولة المستقبلة، إلا أن هذا الإعفاء غير متفق عليه فقها و قضاءً و خصوصا إذا ما ارتكب هذا المبعوث الدبلوماسي جرائم حرب، التي تختص بنظرها المحكمة الجنائية الدولية.

و جاءت أهم نتائج الدراسة أن الحصانة القضائية الجنائية التي يتم منحها للمبعوثين الدبلوماسيين أمام قضاء الدولة المعتمد لديها لا تعفيه من الخضوع للقضاء الدولة المعتمدة (قضاء دولته) و أيضاً لا تعفيه من الخضوع للمحكمة الجنائية الدولية في حالة كانت هذه الدولة غير راغبة أو غير قادرة على الاضطلاع بالتحقيق والمقاضاة.

و جاءت أهم التوصيات : ضرورة إنشاء جهاز تنفيذي خاص بالمحكمة الجنائية الدولية، مهمته تنفيذ الأحكام والقرارات التي تصدر عن هذه المحكمة بحق المتهمين بارتكاب جرائم الحرب، و ذلك بسبب الصعوبات التي تتعرض لها المحكمة في ظل افتقارها للجهاز التنفيذي.

الملخص الإنجليزي

This study tackles the question of the extraditing the diplomatic agents who are charged with war crimes commission in the light of having judicial immunity which exempts in its penal part the diplomatic agents (the permanent and the temporary) from the subordinating to the judicial forensic of the receiving state.

Needless to say, such an exemption is not agreed jurisprudence, judicially, and especially if the diplomatic agent does not committee war crimes which by its way is concerned the international forensic court.

The study depends on the descriptive analytical approach which will be used to identify the phenomenon of the study which is the extradition of the diplomatic agents who are charged with war crimes and putting it in the right framework as well as elucidating all of the surrounding circumstances which are be said to be the judicial penal immunity as well as the stance of the states and the local and national law to it.

The study comes in the form of chapters.

The first is a general introduction about the study.

The second chapter tackles the essence of the diplomatic and judicial immunity as well as the privileges and the essence of war and its elements.

The third chapter tackles the jurisdiction the international forensic court on diplomatic persons and the effect of that on the diplomatic immunity and the ways of prosecuting the diplomatic agents.

The fourth chapter tackles the question of the summing the specialty question of the international forensic court.

The study ended with the fifth chapter (conclusion, findings, and recommendations).

The most important findings: the judicial forensic immunity which is granted to the diplomatic agents in forming of the state judiciary that is accredited to it, does not exempt them from the state judiciary subordination (the state judiciary).

Moreover, it doesn’t exempt them from subordinating to the international forensic court if such state is not satisfied or unable in fulfilling judiciary or investigation.

The most important recommendations were: the necessity of making an executive system that is concerned with the international forensic court that is also concerned in executing the decisions and laws which are issued form this court regarding to those who are charged with war crimes due to the difficulties that the court exposed to in the light of lacking the executive system.
