The occurrence of a pandemic has two effects in private law.

The first is the emergency circumstance, and the second is force majeure, which exempts us from responsibility.

The emergency circumstance arises due to a foreign cause outside the carrier's control and leads to him being charged with financial obligations that exceed his financial ability and solvency, which leads to the collapse of his economic position unless the legislator intervenes to enforce it (Articles 146/2 and 878) an Iraqi civilian.

The second is the impossibility of implementation, as the pandemic results in the ence of liability, due to the impossibility of the carrier's implementation of its obligations.

And we try in this research to shed light on the emergency circumstance and the foreign reason that leads to the impossibility of the carrier's implementation of his contractual obligation to make a spatial change of goods or people.
