The paper aims to identify the possibilities and constraints offered by the draft Libyan constitution as a model for reforming local administration, by the transfer of authority and responsibility for public functions from the central government to subordinate or quasi-independent government organizations, In the draft constitution and law (59) of 2012 for the system of local administration in Libya and its amendments.

The paper concluded that any constitutional draft aimed at reforming local administration should include all the powers of the central authority and those relating to localities.

It should include transitional constitutional arrangements, which will organize the gradual transition from old patterns to new decentralization, until local cadres are trained.

Dealing with non-transferable functions at the local levels, as well as coordination and cooperation with the central level, as most local administration units are not ready to carry out their specializations which prevents achieving the desired results.
