تشكل استقلالية الموظف الدولي ضمانا لحياد ونزاهة المنظمات الدولية.

حيث تتجلى هذه الاستقلالية من خلال التزامات تقع على عاتق كل من الدول الأعضاء والموظفين الدوليين؛ فمن جهة، يجب على الدول الامتناع عن أي عمل من شأنه التأثير على الموظفين في ممارسة وظائفهم، ومن جهة أخرى، يتعهد الموظفون بتجنب أي تأثير خارجي.

ومع ذلك، تظل استقلالية الموظفين نسبية نظرا لتدخل الدول في تسيير حياتهم المهنية.

لهذا، ومن اجل استئصال الموظفين من الضغوطات الخارجية، تم وضع آلية قانونية حمائية، تتكون من مجموعة من الامتيازات والحصانات، من أجل ضمان استقلالية الوظيفة العمومية الدولية.

The independence of international civil servants is such as to guarantee the impartiality and integrity of the action of international organizations.

it is expressed through obligations that bind both member states and civil servants; states must abstain from any act tending to influence civil servants in the exercise of their functions, and civil servants undertake to avoid any external influence.

nevertheless, the independence of civil servants remains relative given the intervention of the states in the management of their careers.

as a result, with the aim of preserving the emancipation of civil servants with regard to the states, a legal mechanism of protection, consisting of privileges and immunities, is put in place in order to guarantee the independence of the international administration.

الملخص FRE

L'indépendance des fonctionnaires internationaux est de nature à garantir l'impartialité et l'intégrité de l'action des organisations internationales.

elle se traduit par des obligations qui engagent aussi bien les etats membres que les fonctionnaires; les etats doivent s'abstenir de tout fait tendant à influencer les fonctionnaires dans l'exercice de leurs fonctions, et les fonctionnaires s'engagent à se soustraire à toute influence extérieure.

toutefois, compte tenu de l'intervention des etats dans la gestion de la carrière des fonctionnaires, l'indépendance de ces derniers reste relative.

de ce fait, dans l'objectif de préserver l'émancipation des fonctionnaires à l'égard des etats, un mécanisme juridique de protection, constitué de privilèges et d'immunités, est mis en place afin de garantir l'indépendance de l'administration internationale.
