في إطار سعيها الدائم لإرساء استراتيجية شاملة للوقاية من الفساد ومكافحته، حرصت الدولة الجزائرية على إصلاح وتكييف المنظومة الوطنية للوقاية من الفساد ومكافحته مع أحكام التعديل الدستوري لسنة 2020، الذي استحدث مؤسسة دستورية جديدة تطلع بمهام رقابية سميت ب "السلطة العليا للشفافية والوقاية من الفساد"، أصدر المشرع حديثا القانون 08-22 المحدد لتنظيميها وتشكيلتها وكذا صلاحياتها.
أعطى المشرع في صلب هذا القانون إلى هذه السلطة جملة من الصلاحيات توصف بالواسعة مقارنة بتلك التي كانت تتمتع بها الهيئة الوطنية للوقاية من الفساد ومكافحته الملغاة، والتي طغى عليها طابع المحدودية، يتجلى ذلك من خلال صلاحيات تنفيذية رقابية استشارية غير مألوفة، تجسد توجه جديد من الدولة الجزائرية في إرساء استراتيجية شاملة في الوقاية من الفساد ومكافحته، قوامها الشفافية والنزاهة وروح المساءلة.

As part of Algeria's endeavor to establish a comprehensive strategy to prevent and combat corruption, Algeria has endeavored to reform and adapt the national system for preventing and combating corruption to the provisions of the constitutional amendment of 2020.
which created a new constitutional institution with oversight functions called the "supreme authority for transparency and the prevention of corruption", the legislature recently promulgated law 22-08 establishing its organization, composition, and powers.
the legislator at the heart of this law gave this authority a range of powers described as broad compared to those of the abolished national corruption prevention and control authority overshadowed by limitations, this is evidenced by uncommon advisory oversight executive powers transparency, integrity and accountability", reflects a new direction from Algeria in establishing a comprehensive strategy for preventing and combating corruption, based on transparency, integrity, and accountability.
الملخص FRE
Dans le cadre de ses efforts visant l’élaboration d’une stratégie complète de prévention et de lutte contre la corruption, l’etat algérien a veillé à la réforme de l’organe national de prévention et de lutte contre la corruption et à son adaptation aux dispositions de la révision constitutionnelle révisée en 2020, instaurant une nouvelle institution constitutionnelle exerçant des fonctions de contrôle sous la dénomination «la haute autorité de transparence et de prévention de la corruption» que le législateur a déterminé son organisation, sa composition ainsi que ses prérogatives en promulguant, récemment, la loi 22-8.
dans le cadre de cette loi, le législateur a attribué à la haute autorité un ensemble d’attributions qualifiées de vaste comparées à celles jugées « limitées » dont jouissait l’ex organe national de prévention et de lutte contre la corruption.
cela se traduit par des prérogatives exécutives de contrôle et de consultations inhabituelles reflétant une nouvelle orientation de l’etat algérien dans l’élaboration d’une stratégie complète de prévention et de lutte contre la corruption, basée sur la transparence, l’intégrité et le sens de responsabilité.
