الملخص العربي

الحمد لله رب العالمين و الصلاة و السلام على سيد المرسلين سيدنا محمد و على آله و صحبه أجمعين، و بعد: فهذا بحثي الموسوم: )الجمود و التجديد في الفقه الإسلامي - دراسة تطبيقية( و هو يعالج البحث تحديامن التحديات المعاصرة التي واجهت الفقه الإسلامي، ألا و هو التحدي الذي أطلقه التنويريون و الحداثيونبأن الفقه الإسلامي أصابه الجمود الفكري، و لا يمكنه مواكبة تطورات العصر، و معالجة النوازل المستجدة، و كأنه مهيئ لمرحلة العصور القديمة فقط، و بدأوا يسخرون من ذلك و يأتون بنقول من كتب الفقه القديمة، و يجعلونها محلا للسخرية، و نسوا و تناسوا بأن الفقه الإسلامي مصدره الشريعة الإسلامية الخالدة، و من أهممصادره القرآن الكريم و هو كلام الله العظيم و السنة النبوية المشرفة، و هذان المصدران فيهما العلاج لكل مايحتاجه المسلم و المسلمون إلى يوم الدين.

ولم يكن هذا التحدي كلاما نظريا فحسب، بل منهم من سعى حقيقةلإلغاء مجلة الأحكام العدلية، و استبدلها بالقانون الحديث، و فعلا هذا ما حصل في حين كل ما موجود في القانونالحديث تجده في مجلة الأحكام العدلية و زيادة.

و من ثم تطرقت إلى التجديد المستمر للفقه الإسلامي و مواكبتهلكل تطورات الحياة، وكيف أن باب الاجتهاد مفتوح لا يغلق، و يمكنه استيعاب كل المستجدات و النوازل علىمر الأزمان، و تناولت مسألة من النوازل ووضحت فيها كيف يمكن للفقه معالجة أي مستجد و نازلة، و تطرقتإلى المجامع الفقهية وكيفية معالجاتها للأمور المستجدة، وغير ذلك من الأمور التي أثبتت أن الفقه ليس بجامدوأنه متجدد و متطور دائما، ومواكبا للحياة بأدق تفاصيلها، والتوضيح الكامل سيكون في ثنايا هذا البحث بإذنالله تعالى.

الملخص الإنجليزي

In the name of God the most Merciful، the most CompassionateThank God، the Lord of the Worlds، and peace and prayer supplication to the Lordof the Apostles، Our Lord Muhammad، and to his god and companions، and after: This is a summary of my research tagged: ( Rigidity and innovation in Islamicjurisprudence - a practical study ) and it addresses one of the contemporary challengesfaced by Islamic jurisprudence، namely the challenge launched by the Enlightenmentand hadiththat Islamic jurisprudence has been hit by intellectual inertia، and can notkeep up with the developments of the era، and the treatment of emerging shortcomings، as if it is ready for the stage of antiquity only، and they began to make fun of it andcome to say from the books of ancient jurisprudence، and make it a place of ridicule.

They forgot that Islamic jurisprudence comes from the eternal Islamic law، and oneof its most important sources is the Holy Quran، which is the great word of Godand the honorable Prophet's Sunnah، and these two sources are the cure for all thatMuslims and Muslims need until the day of judgment.

This challenge was not onlytheoretical، but also one of them who really sought to abolish the Journal of JusticeJudgments، and replace it with modern law، and indeed that's what happened whileeverything in modern law you find in the Journal of Justice Judgments and Increase.

And then i touched on the continuous renewal of Islamic jurisprudence and keepingup with all the developments of life، and how the door of ijtihad is open does notclose، and can orb all the developments and disputes over time، and addressed theissue of the shortcomings and explained how the jurisprudence can address any newand down، and touched on the jurisprudence and how to deal with the new things، and other things that proved that the jurisprudence is not rigid and that it is renewedand developed always In keeping with life in its finest detail، the full explanationwill be in the context of this research، God willing.
