This article aims to clarify the drunkenness impact on proving the retribution punishment in jurisprudence and law, providing the related judicial applications and how a dunked killer is punished.

The study employs the analytical descriptive approach by defining “drunkenness” and “retribution punishment” giving some examples and commenting on such examples.

The study concludes with a number of findings, the most important of which are: drunkenness is a state of the mind in which the drunker is a person who is not able to distinguish between good and bad deeds and things.

Retribution is a punishment in which the killer is killed as an Islamic rule.

The dunked killer is to be punished with retribution, and that drunkenness cannot be an excuse; a drunker is taken by all his deeds and sayings, and retribution must be applied like other undrunk persons.
