The Moroccan legislator did not define the real estate developer but referred to it only in the General Tax Code through articles 30 and 89.

Although this profession does not have a specific legislative regulation in the Moroccan law, the general rules have been applied on every violation committed by the real estate developer, since the materials he uses for his work might have a negative impact on both human beings and the environment and put it at risk.

Accordingly, a penalty must be imp osed and the latter shall be compensation.

However, the question is whether the general rules of civil liability will be applied with regard to compensation for environmental damage? While damage to people and property is not problematic in terms of subjecting them to the general rules of compensation, environmental damage is difficult in terms of how to repair it.

This is because it has special characteristics - often invisible - that have caused civil liability’s rules to evolve in order to fit the nature of environmental damage.

Law No.

11.03 relating to the protection and restoration of the environment has a novelty in which it addresses the difficulty of compensating environmental damage and seeks to overcome this difficulty, through the article 64 in which it is stipulated that a person, whether material or moral, and engaged in an activity which would harm the environment, can request the identification of the responsibility in a lump sum for each incident.

This amount is set by a regulatory text.

We also know that compensation is one of the effects of the liability of the real estate developer for the environmental damage he has caused.

The nature of the compensation is either in the form of a compensation in kind or a financial compensation .

The compensation in kind takes the form of restitution as compensation, for example , the construction of a building by the real estate developer on a land designated for gardens and green spaces.

In this case the compensation may be in kind by the destruction of the building.

The financial compensation shall be in the case where it is not possible to perform in kind, and the financial compensation shall be in the amount of money paid to the injured at one time.

The lawsuit is considered one of the most important legal means by which personal and financial rights are strengthened, which are exercised when a violation occurs by the injured party to obtain the appropriate compensation.

However, the Moroccan legislator has also enacted a set of legal requirements, which are mainly aimed at trying to end the civil liability represented in the foreign case as a mechanism for refusing the compensation claim and the waiver as a mechanism for refusing compensation.
