الملخص العربي

تنفيذ الأحكام في الفقه الإسلامي و القانون الوضعي التشادي (دراسة مقارنة) الحمد لله و الصلاة و السلام على من لا نبي بعده، سيدنا محمد و على آله و صحبه أجمعين، و سلم تسليما كثيرا، أما بعد : فإن الله تعالى أكرم هذه الأمة بالرسالة المحمدية و جعلها خاتمة للشرائع، و استودع فيها ما يحقق صلاح البشرية، و رعاية حقوقها، إذ قد وضع فيها من الأحكام الشرعية ما يجعل الأفراد و الجماعات تتمتع بكافة الحقوق، فلا تكدير في حياتها، و لا عدوان على حقوقها، فإذا امتدت يد الغير للاعتداء و الظلم و الغصب و الطغيان، فقد شرع إقامة الحدود برد الحقوق المغتصبة، و جعل من بين الحقوق و الدماء تنفيذ الأحكام بما جاءت به الشريعة المطهرة بسبب المحافظة على الأنفس، و نحن الآن في عصر كثرت فيه الفوضى، فهناك الجرائم اليومية التي تذكر هنا وهناك بأنواعها المختلفة، و نسبة لضخامة حجم الموضوع، أنشئت محاكم متخصصة في البلاد المتقدمة، و لما كانت هذه الوسيلة من الموضوعات الفقهية التي اشملت على درر من توثيقات الحقوق، أحببت أنوه بمكانتها في الفقه الإسلام و القانون الوضعي التشادي، و قد اقتضت طبيعة البحث أن نقسمه على النحو التالي : المبحث الأول : و يشمل معنى التنفيذ في الفقه الإسلامي و القانون الوضعي التشادي المبحث الثاني : مشروعية تنفيذ الأحكام و أهميتها و شروطها في الفقه الإسلامي و القانون الوضعي التشادي المبحث الثالث : المخول بتنفيذ الأحكام في الفقه الإسلامي و القانون الوضعي التشاد.

المبحث الرابع : أنواع التنفيذ في الفقه الإسلامي و القانون الوضعي التشادي.

المبحث الخامس : إشكالات التنفيذ لدى المحاكم التشادية.

Praise be to God, and prayers and peace be upon the one after whom there is no prophet, our master Muhammad and all his family and companions, and may the peace and blessings of God be upon him abundantly.

God Almighty has honored this nation with the Muhammadan message and made it a conclusion to the laws, and deposited in it what achieves the welfare of mankind and the care of its rights, as He has placed in it legal rulings that make individuals and groups enjoy all rights, so there is no disturbance in their life, nor aggression against their rights.

Others to aggression, injustice, usurpation and tyranny, the establishment of the border has begun to return the usurped rights, and made among the rights and blood the implementation of the provisions with what the purified Sharia brought because of self-preservation, and we are now in an era in which chaos abounds, there are daily crimes that are mentioned here and there with their different types, and the ratio of Due to the magnitude of the issue, specialized courts were established in the developed countries, and since this method was one of the jurisprudential topics that included pearls of documentation of rights, I wanted to note its position in Islamic jurisprudence and positive law of Chad, and the nature of the research required that we divide it as follows: Introduction 1.

The second topic: the legitimacy of the implementation of rulings, their importance and conditions in Islamic jurisprudence and Chadian positive law 3.

The third topic: authorized to implement the provisions in Islamic jurisprudence and positive law of Chad 4.

The fourth topic: Types of implementation in Islamic jurisprudence and Chadian positive law 5.

The fifth topic: problems of implementation in Chadian courts 6.
